General Conditions Governing the Use of the Internet Sites Operated by Loto-Québec and its SubsidiariesCONDITIONS OF USE

Loto-Québec and its subsidiaries (hereinafter "Loto-Québec") operate a number of informative Internet sites (hereinafter the "Portal") and social media accounts (hereinafter "Accounts"), in order to offer everyone free access to a wealth of information about Loto-Québec, its products and the activities it offers. Specific Online Gaming Conditions of Use


The persons accessing or otherwise using the Portal or Accounts (hereinafter the "User(s)"), access or use it of their own volition. When applicable, any person authorising the use of the computer or equipment permitting access to the Portal or Accounts is also deemed a "User" and is bound by the terms of these conditions and by any other applicable terms.

Consequently, Users accept that the "General conditions of use" contained herein govern the content and operation of the Portal and Accounts, as well as the Users' authorized use of them. Loto-Québec may modify the present conditions of use at any time without prior notice. These modifications apply to all Users. Therefore, it is recommended that Users consult this page regularly to remain apprised of the latest conditions of use. Loto-Québec respects its Policy concerning privacy and the protection of personal information as it applies to Users.

Loto-Québec does not authorize any party to offer games of chance and skill on the Internet.

 

1. Information accuracy

Even if many efforts have been made to develop the Portal and Accounts, Loto-Québec offers no guarantees, either express or implied, as to the accuracy, exhaustiveness, validity or timeliness of the provided information. Loto-Québec retains the possibility, at its sole discretion and without prior notice, to remove, modify or update all or part of the contents of the Portal and Accounts.

 

2. Prices, packages and schedules

Certain Web sites on the Portal or certain Accounts include prices, packages, and schedules. The prices posted on the Portal or Accounts are in Canadian dollars, unless otherwise specified. The dates, times, conditions and prices of packages, hotel rooms, events, tournaments or other activities are subject to change without notice and may be subject to additional conditions than those indicated on the Portal or Accounts. We therefore advise our clients, guests and organizers to confirm any information posted on the Portal or Accounts with the appropriate source when necessary.

 

3. 18 and over

Lotteries are restricted to persons 18 years of age or over.

 

4. Lottery results

The lottery results posted on the Portal are not official. In the event of a discrepancy between the results listed on the Portal and Loto-Québec’s official winning list, the latter shall prevail. To claim a winning ticket, see explanations on the back of it.

6. Exclusions from liability

Loto-Québec does not guarantee use of the Portal and Accounts, and Users agree to use them as is and at their own risk.

Loto-Québec and its directors, employees and agents are at no time responsible in civil or other fashion for any loss or damages whatsoever, including, but not restricted to, a loss of profits, an interruption of activities, or the loss of programs or data which could result from:

(i) the use of the Portal, any Internet site or social media accounts or any Internet site linked to the Portal by hyperlink or otherwise;

(ii) the modification or deletion of all or part of the Portal or Accounts, including a hyperlink;

(iii) any errors, omissions, inaccurate or outdated information presented on the Portal or Accounts or received by Users subsequent to a request for information submitted on the Portal or Accounts;

(iv) the consequences of any harmful programming code that could install itself on or be transmitted via the Portal or Accounts.

 

7. Intellectual property

Certain names, words, titles, expressions, logos, icons, graphic elements, drawings and diagrams or other content appearing on the pages of the Portal or Accounts are commercial designations or trademarks held by Loto-Québec and its subsidiaries, or commercial designations or trademarks granted to them by virtue of a permit or license. All other material contained on the Portal and Accounts is also protected by copyright.


The unauthorized downloading, retransmission, copying or modification of trademarks, images, text or data contained on the Portal or Accounts may contravene federal or provincial laws, and especially the laws pertaining to trademarks, industrial drawings or copyright, and may subject the User to legal proceedings.

Except for the purposes of navigating the Internet, or unless otherwise indicated, it is strictly prohibited to copy, redistribute, reproduce, republish, store on any medium, retransmit or modify the information contained on the Portal and Accounts, or to make public or commercial use thereof in any way whatsoever.

The attached list contains the trademarks owned by Loto-Québec and its subsidiaries [in French only, PDF – 265 KB]. In order to obtain ownership of a trademark, and as requested by the Loto-Québec's Corporate Secretariat, trademark agents file registration applications with the Canadian Intellectual Property Office. Loto-Québec owns temporary brand names, valid for 15 years and renewable. It also own official brand names, valid in perpetuity. Registering trademarks protects them from being used by third parties without approval and makes those who would do so liable to prosecution. This list is updated on the first business day of every month.

 

8. Domain names

All domain names are the exclusive property of Loto-Québec and may not be appropriated or infringed upon by way of hyperlinks or framing. Similarly, the registration of closely similar domain names will not be tolerated.

 

9. Hyperlinks from the portal or accounts

The Portal and Accounts feature various hyperlinks which will direct Users to other sites. These links are made available to Users for their convenience only and in order to offer them a more intuitive and pleasant navigation experience. The existence of any such link in no way whatsoever constitutes an implicit or explicit support of the site concerned, of its content, or of any other site(s) associated with such a site. Furthermore, Loto-Québec assumes no responsibility whatsoever for such content.


Loto-Québec is free to add, remove or modify any link appearing on the Portal or Accounts at any time. Loto-Québec also assumes no responsibility for the choice of the links provided.

 

10. Hyperlinks to the portal or accounts

It is possible that the Portal or Accounts may appear among hyperlinks offered by third-party sites. Loto-Québec is not responsible for the content of any of these sites, or for any link present on these sites.


Loto-Québec has no control over the sites containing links to the Portal or Accounts. The fact that links to the Portal or Accounts exist does not mean that Loto-Québec supports, approves or otherwise recognizes the content of any such site or any link present on these sites.

All Users who wish to establish a hyperlink to the Portal or Accounts must first accept the Conditions outlined below. By establishing a link to the Portal or Accounts, Users accept that the Web site containing a link to the Portal or Accounts:

1. cannot employ the framing technique, a mirror site or any other similar method without the prior consent of Loto-Québec;

2. cannot employ a link integrated with images posted on the Portal or Accounts;

3. cannot give the impression that there is an affiliation of any kind between the company or the individual benefiting from the Web site and Loto-Québec, nor that Loto-Québec supports the products, services or any other content featured on the Web site, unless there is a written agreement stating otherwise;

4. cannot give a false or misleading impression of the products and/or services of Loto-Québec;

5. cannot display a Loto-Québec logo, unless a written agreement states otherwise;

6. cannot contain material that might be interpreted as being in bad taste or offensive, or which targets or appeals to people under the age of 18. In this instance, reference is made to the Code of advertising standards [PDF – 46 KB];

7. cannot promote or make reference to illicit or illegal activities.

Loto-Québec assumes no responsibility for the content of any site containing a hyperlink to the Portal or Accounts. Loto-Québec can, at all times and at its sole discretion, immediately abolish the privilege of Users to establish a link to the Portal or Accounts.

As a general policy, Loto-Québec does not subscribe to reciprocal link-sharing agreements.

 

11. Language

In the event of a discrepancy between the French and English versions of the Portal or Account content, the French version of shall prevail.

 

12. Specific condition

In the event of a discrepancy between one of the conditions stated in the General conditions for use and a specific condition for use displayed on a specific Portal or Account page and related to a particular content, the specific condition shall prevail.

 

13. Jurisdiction

In the event that Users' use of the Portal or Accounts results in any conflict, such conflict must be resolved in accordance with the laws applicable in Québec and in Canada before a Montréal district court.

 

14. Informations and comments

All Users are invited to address their questions, comments and requests to Loto-Québec Customer Service.

¹ Certain sites have more than one Internet address (URL) in order to facilitate access to the site, and certain sites or microsites with different addresses can be added by Loto-Québec from time to time. All these sites are part of the Portal and have an Internet address (URL).
